If I am reading this right, Condoleeza Rice now has the power to invetigate, request legal BC of the O, by executive order. RIGHT? If this is right and has been done....hooooraaaay for Bush. Bush fixed it to where we can find out, Bush knows the truth.

I think Bush waited until the Friday before his exit to put the EO in place before Obama is inaugurated and too late for Congress to attempt to override it before the inauguration. Brilliant timing. Produce the damn birth certificate before you step up to the podium.

Ordinarily I might disagree with you on this issue, since elected officials are immune to background checks.

HOWEVER, Obama’s NOT an elected official at the moment... One could argue that he's in limbo between offices, having just resigning his Senate seat last month... but not assuming the Presidency at the moment.

If the EO was released by Bush to catch Obama, while he's no longer a Senator, but not quite yet in the Executive, with Congress out of session, and them all focused on the Inauguration — the timing could have been well planned.

If true, the same would apply to a possible co-conspirator. Mr. Biden, for example, could receive new scrutiny on HIS security clearance, having resigned his Senate seat last Thursday ;)
