The courts haven't agreed with that position as yet. I very much doubt that they will, but we shall see.

The courts have thus far refused to hear the merits of the cases, but only on the basis of technicalities...

They have not allowed anyone for officially ask the question. That can hardly be defined as disagreeing with the merits of the question...
