Scotus puts out a list of miscellanious orders on conference days. One of them is cases denied cert. Donofrio’s case is not on the denied list.
Traditionally, SCOTUS puts out the list of cases granted cert on Friday. This gives the plaintiffs of those cases a head start on preparing their briefs. Donofrio's case was not on that list. The list of cases denied comes out on Monday.
