You might have missed it when President Bush signed that nice little piece of legislation that basically tramples the Posse Comitatus Act...recall
HR 5122 of 2006--The John Warner National Defense Authorization Act of 2007 (Public Law 109-364)?
Wikipedia summarizes its provisions, including:
Expansion of the President's power to declare martial law under revisions to the Insurrection Act, and take charge of United States National Guard troops without state governor authorization when public order has been lost and the state and its constituted authorities cannot enforce the law (repealed as of 2008);
Fortunately, some of it has been repealed, but I think that its original passage demonstrates that the GOP is no friend of the Constitution these days, either.
