Doug From Upland made a good point on another thread.....the really crucial date is Wednesday, December 10th., when the Electoral College casts it's votes.
Failing that, it would, as you say, be a case of impeachment.
It is really quite silly, when all Obama has to do is produce a legal COLB and end this speculation.

The new Congress meets to certify the votes of the Electoral College. If, just prior to Jan. 6, the Supreme Court has ruled that Obama is ineligible, the Democrat congress will choose a president.
