I just hope the people who supported this bailout are able to see video of Nancy and Barney’s speech following the vote.

And since when did expenditure bills have to originate in the house?..........

Section 7. All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills.

Go back to sleep! This "bill, did NOT originate in the Senate. The original $700 bn plan was part of the bill passed today. In congresscritter speak, that means it "originated" in the House!

Section 7. All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills.

Every bill which shall have passed the House of Representatives and the Senate, shall, before it become a law, be presented to the President of the United States; if he approve he shall sign it, but if not he shall return it, with his objections to that House in which it shall have originated, who shall enter the objections at large on their journal, and proceed to reconsider it. If after such reconsideration two thirds of that House shall agree to pass the bill, it shall be sent, together with the objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a law. But in all such cases the votes of both Houses shall be determined by yeas and nays, and the names of the persons voting for and against the bill shall be entered on the journal of each House respectively. If any bill shall not be returned by the President within ten days (Sundays excepted) after it shall have been presented to him, the same shall be a law, in like manner as if he had signed it, unless the Congress by their adjournment prevent its return, in which case it shall not be a law.

Every order, resolution, or vote to which the concurrence of the Senate and House of Representatives may be necessary (except on a question of adjournment) shall be presented to the President of the United States; and before the same shall take effect, shall be approved by him, or being disapproved by him, shall be repassed by two thirds of the Senate and House of Representatives, according to the rules and limitations prescribed in the case of a bill.

Had you read some of the other threads discussing this issue, you would have already found the answer.

The Senate attached the "bailout" provisions as an amendment to an existing bill that originated in the House. The House had already approved the original bill, but had to hold another vote to approve the changes.

An unrelated finance bill originated in the House andwas senet to the Senate. Its contents were completely replaced by the Senate with the bailout, and it was then approved by the House. It was against the spirit of the Constitution, but complied with the letter. I think that only the House would have standing to complain, and they approved the bill. In my opinion a legal challenge on these grounds will get nowhere.

I am tempted to take the McCain sign OUT of my yard and rip the bumpers stickers off my truck.. I wish it were Sarah Palin at the top of the ticket.. it is becoming clear that McCain is using her for SHOW and not listening to her advice.... I am going to take a couple of days to calm down a bit.. but it’s clear that John McCain is STILL John McCain!!

They passed a House Resolution, as amended. The House accepted their amendments. Constitution satisfied. Unecessary if Pelosi had been able to count on Monday. My 401k would look a lot better if she had kept her mouth shut. Plus less pork.

It is OBVIOUS to me that the "bailout bill" is a clear violation of Article I Section 7 of the U.S. Constitution in that it DID NOT originate in the House...

It did.

It was HR 1424. As others have stated it started in the House as a completely different bill, but was gutted with only the number remaining. Kind of like NASCAR cars still having Chevy, Ford or Dodge nameplates on them.

Contact the "no votes. Maybe there's a taxpayer coalition with a lawyer on staff. A no vote in the House would have some info. I won't name names here so nobody gets put on the spot in this very public forum. FIND A TAXPAYER COALITION WIT A LAWYER.

Or a Petition with teeth that covers every state.

That was the Senate's double-cross trick. They *amended* a prior bill passed up from the House. Of course, the *amending* they did wasn't really amending -- it was just adding 700 billion dollars worth of pain. Then they voted and passed the doctor'd up bill back to the House for final approval. It's completely unethical and abusive to the intentions of the nation's founders. But ... it isn't illegal and it's been done for decades if not longer, so there is ample precedent. That argument, I'm afraid, is a non-starter. However ... there is the "equality under the law" argument ... who is the Fed to say which industries should be bailed out and which ones are left to die. Judge Napolitano pegged that one in July : click

"Everyone in government takes an oath to uphold the Constitution. Shouldn't we expect that they will comply with their oaths?"
