DURHAM -- Lawyers on both sides of one of the three federal civil-rights lawsuits stemming from the Duke lacrosse case have agreed to move back a deadline for the city government and Duke University to file dismissal motions.

Defense motions in the case filed by unindicted lacrosse players Breck Archer, Ryan McFadyen and Matt Wilson had been due Friday. But instead, lawyers for the players, the city, Duke and other defendants agreed to wait until July 2.

The delay will give defense lawyers time to respond to new legal arguments the players made in an amended complaint their attorney, Bob Ekstrand, filed on April 18.

Ekstrand's filing contained "several new factual allegations, as well as several legal theories not presented" by the players' original lawsuit in December, the joint postponement motion said.

U.S. District Judge James Beaty Jr. has to approve the delay, but so far he has accepted scheduling proposals offered by attorneys in all three of the federal lacrosse lawsuits.

Meanwhile, a city lawyer told elected officials this week that to gather information for one of the lawsuits, technicians have to copy the hard drives of laptop computers used by elected officials.

Interim City Attorney Karen Sindelar relayed that news to City Council members at the end of the council's biweekly work session on Thursday and asked them to bring their computers in for copying.

She didn't specify which of the lawsuits triggered the move.

In addition to Ekstrand's case, the city also faces claims by falsely accused former Duke players David Evans, Collin Finnerty and Reade Seligmann, and by a group of 38 current or former members of the Duke lacrosse team.

When asked about the request after Thursday's meeting, Sindelar backed off the assertion that it was tied to the lacrosse case. She said she was merely relaying a request to the council from Assistant City Attorney Kim Grantham.

Grantham is, however, the assistant city attorney who's been working with lawyers at the Durham law firm of Faison & Gillespie and the Washington, D.C., firm of Steptoe & Johnson to craft the city's defense in the lacrosse cases.

All three lawsuits are in the preliminary stages, and the various parties involved in them have not yet agreed on discovery procedures. Sindelar indicated it's possible the request for the computer data is part of the city defense team's research.

She added that background work on the cases is ongoing. Although the outside lawyers are handling most of it, the cases nonetheless are taking anywhere from a third to half of Grantham's time, she said.

... after removing anything incriminating, of course!

I wouldn’t doubt if they ran kill disk on their computers at some time to get rid of everything.
