Haditha Article 32: Capt. Randy W. Stone

Hearing fact sheet

The accused: Capt. Stone was the staff legal officer for the 3rd Battalion, 1st Regiment when the incident occurred. Stone, who completed his officer training course in August 2003, was on his first tour in Iraq at the time of the Haditha incident. He is a 34-year-old Maryland native, currently assigned to legislative affairs duties. Capt. Stone is facing up to two years in prison and dismissal from the service if ordered to trial, convicted and sentenced to the maximum punishment.

Preferred Charges and Specifications:

Charge: Violation of the UCMJ, Article 92

Specification 1 (Violation of a lawful order): wrongfully failed to ensure accurate reporting and a thorough investigation into a possible, suspected, or alleged violation of the law of war by Marines from his Battalion. (Maximum punishment dismissal, forfeiture of all pay and allowances, and confinement for 2 years).
Specification 2 (Dereliction): negligently failed to ensure that this possible, suspected, or alleged violation of the law of war was accurately reported to higher headquarters.
Specification 3 (Dereliction): negligently failed to ensure that a thorough investigation was initiated into this possible, suspected, or alleged violation of the law of war. (Maximum punishment: [willful] Dismissal, forfeiture of all pay and allowances, and confinement for 6 months [through neglect or culpable inefficiency] Dismissal, forfeiture of two-thirds pay per month for 3 months, and confinement for 3 months).

Investigating officer: Maj. Thomas McCann

Convening authority: Lt. Gen. James Mattis, commanding general for the 1st Marine Expeditionary Force and Marine Forces Central Commander for Afghanistan, Iraq and Africa.

Expected duration of the hearing: At least four days.

Unprecedented prosecution: The charges against Capt. Stone represent the first time a legal officer has been accused of a crime arising out of his handling of a battlefield report.

In Capt. Stone's defense: Lead civilian attorney, Charles Gittins, says, "General Huck did not believe there should have been an investigation, nor did the staff judge advocate for the regiment. My client was the lowest-level guy and he reported everything that he had been told. There was no requirement that he should have done more. I don't think the people who made the charging decision thought it through -- it seems like they just threw everything at a dartboard."

Expected witnesses: Maj. Gen. Richard Huck (former commanding general of the 2nd Marine Division based at Camp Lejeune, North Carolina, who at the time of the incident, was in charge of troops in Haditha ), "two other Marine officers who were in Iraq when the killings took place" (according to the North County Times), Sgt. Sanick Dela Cruz.

What's crucial: Maj. Gen. Huck's testimony could clear Capt. Stone. (As a side note, it's very rare for a general to testify for either side in a court case. Naturally, the investigating officer will give a great deal of weight to his testimony.)

Also at stake: Three other officers are facing charges similar to those of Capt. Stone: Lt. Col. Jeffrey Chessani, Capt. Lucas McConnell and 1st Lt. Andrew Grayson. The result of Capt. Stone's hearing will impact the other three officers, as well as the three enlisted Marines (Staff Sgt. Frank Wuterich and  Lance Cpls. Justin Sharratt and Stephen Tatum). All the accused are from Camp Pendleton's 3rd Battalion, 1st Marine Regiment.

I realize your a newbie to FR but when things that are posted on open threads here, the poster is expected to be able to verify what is posted.

Your statement the other day implying a presidential candidate is investigating Murtha would have probably been best left unsaid publicly if it can't be verified, also this statement last night.

I investigated the videographer, filmmaker and witnesses. I can’t give anything away, but treason might be in order for a few people including Murtha and Moore. No promises but Murtha will be damn lucky to avoid jail.

Hopefully this is all true and hopefully you are legit but there's really no way we can put much trust in it. You are asking us to believe a lot and we know nothing of you.

What would you like to know?

I can tell you that there was not 24 deaths. I can tell you 15 were civilians, 8 were insurgents and one Marine Terrazas. I can tell you there are not 24 compensation packages. I can tell you they can only produce 15 compensation packages totallying $38,000.

I can also tell you if you google any name with OFAC then their name you can find out if a person is on the US treasury watch list. OFAC is the Office of Foreign Assests Control. They list SDGT Specially Designated Global terrorists.

I can’t promise anything, and i don’t want to jink the trial on Tuesday. But i will be back to the forum when i hear more from my side.

Only the truth. So far you have said nothing in your last post or previous ones that would affirm your claims. I'm not saying I don't believe you but I also am not saying I do.

I'm not after promises, I'm after verification. It's not a trial coming up on Tuesday, it's an Article 32 hearing and we'll be looking forward to hearing more from you, especially if it can be verified.

By trade, I am an underwriter. Not an attorney. I write the legal summaries for corporate bonds, which all minor details have to be covered. When something is out of place it bugs me. MURTHA was stuck in my craw, and i simply would not let the Haditha incident go with out my input. that is why i became involved. I will be damned to let our Marines go down for terrorist witnesses on OFAC.

One other thought that i want you all to realize, the question that i posed to Defense attorneys:

Insurgents will do any dirty tricks. Who is to say the insurgents were mad from their 8 buddies getting killed? Who’s to say that the insurgents didn’t open fire on the dead bodies... just to blame the Marines?

Now you can see what my line of thinking is. It is always follow the money. I started my research with the 15 dead and the receipt for $38,000.

All efforts are appreciated when those efforts work to expose the calculated political actions of murtha, some of which are probably due to the onset of dementia.

Whether senility figures in or not it is evident that his actions have cost lives in our military and that is unforgivable. For this he deserves to spend his remaining days behind bars. He’s managed to escape punishment for his corruption over the years but hopefully he’ll pay a heavy price for betraying our military.

I guarantee to, i will not relent, I will attack Murtha’s credibility until he is behind bars. Using Marines for his political agenda will be stopped, right here right now.
