Liberals argue Bush has no power to defend USA against terrorist or enemies

Article 4, section 4 of the United States Constitution states the following:

Sect. 4. The United States shall guarantee, to every State in this Union, a republican form of government, and shall protect each of them against invasion; and, on application of the Legislature, or of the Executive, (when the Legislature cannot be convened) against domestic violence.

Newsweek, in an article to be published Feb 15, 2006 states that the President cannot kill terrorist here on American Soil.

...Current and former government officials said they could think of several scenarios in which a president might consider ordering the killing of a terror suspect inside the United States. One former official noted that before Flight 93 crashed in Pennsylvania, top administration officials weighed shooting down the aircraft if it got too close to Washington, D.C. What if the president had strong evidence that a Qaeda suspect was holed up with a dirty bomb and was about to attack? University of Chicago law professor Cass Sunstein says the post-9/11 congressional resolution authorizing the use of military force against Al Qaeda empowered the president to kill 9/11 perpetrators, or people who assisted their plot, whether they were overseas or inside the United States. On the other hand, Sunstein says, the president would be on less solid legal ground were he to order the killing of a terror suspect in the United States who was not actively preparing an attack....

This is the biggest problem with those on the Left, in particular those who so hate this nation that they would ignore it's most basic foundations, that being the US Constitution. In their minds, the Constitution is a "Flexible" document that bends to the will of a Liberal and Socialist thought of the moment. Currently, that "Moment of Thought" is that the US Cannot defend itself from Domestic or Foreign Enemies without a law passed by Congress, that all Presidential powers are removed because a president they do not like is holding office.

Using the example above from newsweek, where a terrorist is in possession of a dirty bomb, it would be ok to take them out, BUT if that terrorist put down the bomb to take a break, say a prayer, eat dinner, take a bath, or do something that is not actively planning the destruction of the United States, then the terrorist could NOT be taken out...

Like the way the Liberals interpret the Immigration clause of the US Constitution, they think anybody who even thinks about or set's foot on US Soil is completely immune from any defense by the United States and they are completly protected by the US Constitution.. In otherwords, the Constitution applies to Non-Citizens along with Citizens. What they really mean is if an Invading Army makes landing on US Soil, we must surrender to them immediately because they are now US Citizens with the full protections of the US Constitution. The President, as Commander in Chief then cannot defend the Citizens against this invading Army.. Terrorist may belong to no State or Nation, but they belong to a group wanting the Destruction of the United States. Terrorist Cells, active or non-active, in this nation ARE an Invading army and the President of the United States is the ONLY Branch of Goverment that the Constitution allows to take ACTIVE and FORCEFUL action to Remove this Foreign and Domestic Enemy from our shores. Congress is tagged by the Constitution to bring up and maintain the armed forces that the president will use to accomplish this Constitutional Dictate. Congress does NOT have the Power to Wage War against Domestic and Foreign Enemies, Congress only has the power to declare and authorize it. Which Congress has done with the War Powers Act of 1974 and the Laws authorizing war against Terrorist and Al Quaida in 2001.
