... the cop also should have known someone is going to start shooting if you break in unannounced...

Why? Shouldn't the people just put up with this for the greater good of limiting the price of drugs or at least driving up the prices? In effect making the cops the agents of monoply for the dealers.

If he demanded one he didn't get it and he should have walked based on his right to a speedy trial. If he was innocent why would he waive his right to a speedy trial?

Answer this: IF a man is asleep in his house...a cops bust in UNANNOUNCED Jury didn't buy that tale.

Uhhh..did you not see the big "HYPOTHETICAL" NEXT TO IT? Now...can you answer the HYPOTHETICAL question? Note "If A man...not if THE man."

Now...answer the question I asked instead of changing the freaking subject.

I don't know. I haven't found anything about that aspect of the case yet.

They say their wasn't even a search warrant for his half of a duplex.

It would be worth looking up whether their are actually two addresses at this location.

did you not see the big "HYPOTHETICAL"

I did. The case was decided on the facts, not your imaginings.

There were two search warrants according to the prosecutor who posted to The Agitator

And there are a lot of aspects that you don't know...and I don't know...and we don't know...and you know what...and I've said this...he might be guilty as sin...but it also may be case of cops made a mistake that cost their buddy his life and are now covering it up and saying they announced and Maye is a murderer...and are making up facts.

The difference b/w you and me is I am willing to admit the guy may be guilty as sin...you aren't willing to answer a hypothetical question and aren't willing to admit the cops may (big MAY) be distorting the facts to fit their side of the story...and guess what...the jury is only going to hear their side...if it is a "To Kill a Mockingbird" type thing. At least I am willing to admit it. You aren't. Wonder who here is being a little unreasonable. Now answer the "HYPOTHETICAL" question.

Cory Maye's prosecutor, Claiborne "Buddy" McDonald :
[...] There were 2 separate search warrants issued for 2 separate apartments in a wood frame duplex which were located side by side one of which was the apartment Maye was in. The warrant was not for the wrong apartment. The warrants were issued by a lawyer/city judge not a lay judge. The warrants were served at the same time by two teams. The testimony was that there were several announcements that they were the police and that they had a search warrant. The occupants in the apartment next to Maye’s allowed entry after announcement and there was no resistance. Maye did not. Porch lights were on in the front of Maye’s apartment and the uniformed officers and marked cars visible in the front yard and on the porch. The officers announced at the front door and then at the back door. The officer who killed was at the front door initially and then went around the back to the back door before entry was made. The defendant Maye testified and the jury did not believe him. You really need to get a copy of the transcript to get an understanding of the entire case. You can get it from Cecilia Fillingame the court reporter in Hattiesburg, Mississippi. If the officer had not had a valid warrant and right to be there the trial judge would not have allowed the case to go forward. [...]

My God! I am not talking about THIS CASE! I am asking you a totally seperate question apart from THIS CASE.

WHAT'S WRONG...CAN'T HANDLE IT? ONE TRACK MIND OR DON'T WANT TO REVEAL THAT YOU ARE A LEFTY?

So...MOJAVE...You really Don't want everyone here to see what you're really about do you...that's why you won't answer a simple hypothetical question...isn't it? It will reveal who you really are.

If you really understood the arguement here...you would answer a hypthetical...but you can't...because you are either to one-track minded or a closet DUer. You can't even branch off for one post to answer a simple hypothetical question.

I am simply astounded. You know...this is a discussion forum. Maybe you ought to learn how to do that before you spend any more time here.

"I've lived in both Mississppi and Southern Louisiana. You're full of crap."

Then you either live in a dream world, or you're part of the power structure. I've lived in Floriduh, South Carolina, and Mississippi, and visited Georgia, Alabama, and North Carolina, and I've run into more than my fair share of GOB cops/sheriffs. In either case, "Yo in a heap o' trubble, boah!

This man wasn't the target of the arrest. The cops screwed up. Someone died. Sad mistake. Don't make it worse by convicting an innocent man of murder.

Yeah...Maybe he lived in Jackson MS and Lake Charles, LA...or some large townlike that. He certainly didn't live in some small southern town where the local cops can b corrupt. I'll admit it's not as bad as it used to be...but 50 years ago...well...thank God if you were born white. I'm thinking part of the power structure...given the absolute reluctance to answer my hypothetical question....which anyone who loves the constitution and who is conservative will answer yes.

Oh no...don't you know...this man picked the middle of the night with his young child in the next room to commit his first crime...killing a cop coming through his door. Makes sense to me.

Maye took a prone position, the better to get a shot up and under the protective vest. He must have known they were cops entering.

My MIL lived in a small town outside Oxford, MS, a few years ago. Banker's wife used to sit on the front porch, drinking and firing her gun at the black neighborhood down the street. From what she said (and if she wasn't exaggerating) they had more than one black "shot while attempting to escape" incident in the 2 years or so she was there. A mutual friend who is black refused to visit her at home, saying it was more trouble than either of them needed in that small community.

even stupid cops will announce their presence before forcing entry

I beg to differ with you on that point. Most "drug warrants" are NO KNOCK and your first warning is the door being kicked open. This is a situation that has ended in tragedy for both police and home owner more times then should be allowed.

GtG
