Lindsay Graham pushes for Karen Williams for SCOTUS; Williams now favorite, per RedState

Per Redstate.org: My friend in the White House thinks that the next nominee will be from the 4th Circuit Court of Appeals -- Luttig or Williams.

****************************

WASHINGTON - U.S. Sen. Lindsey Graham, R-S.C., is recommending a female judge from South Carolina as a Supreme Court nominee.

Karen Williams of Orangeburg, a judge on the 4th U.S. Circuit Court of Appeals for 13 years, has made President Bush's list of possible replacements for retiring Supreme Court Justice Sandra Day O'Connor. His advisers have pored over her resume and judicial decisions.

"I'm enthusiastically advocating her selection," Graham said. "I told the White House she would be a great nominee. She's a good conservative, and she's confirmable."

But court observers say it's unlikely Williams, a former Lexington and Orangeburg County schoolteacher, will make the short list of potential nominees.

"I'd be very surprised," said Jonathan Turley, a law professor at George Washington University.

A confirmation of Williams, 54, would keep two women on the nine-member high court. And her conservative ideals mesh with the president's.

Williams, a former trial lawyer, is known as one of the most conservative judges on the nation's most conservative federal appeals court.

Law professors point to Williams' resume, which includes decisions that likely would be questioned.

In 1999, Williams wrote the 4th Circuit opinion that would have paved the way for overturning the 1966 Miranda case, which outlines the rights - "You have the right to remain silent ..." - that suspects must be read before a police interrogation.

The Supreme Court voted 7-2 that Miranda would stand.

"Miranda has become embedded in routine police practice to the point where the warnings have become part of our national culture," William Rehnquist wrote in the decision. He criticized the 4th Circuit for failing to respect precedent.

"Were she the nominee, you know that case would come up, and I don't think it would play out positively," said David Mann, a political science professor at the College of Charleston.

Also, some of her comments have been seen as callous.

In an opinion overturning a verdict for a woman who had won a sexual harassment suit, Williams said the law against sexual harassment in the workplace is not a "neo-Victorian chivalry code designed to protect" the "tender sensitivities of contemporary women."

Amen to that.

His hijacking the advise and consent process finished him off for me. That was unconscionable.

My hope is that after 2008 Linsey is known as "one termer."

Nobody here in SC cares what Lindsay thinks.
I care how he votes but I don't trust the guy anymore.

Our family will do whatever we can to elect someone who is a true conservative instead of "lightheaded" Lindsay. I am past sick of Hannity having him on almost everyday. It is almost like he is trying to push the McLame/Graham "08 ticket.

Could not agree more. I will actively work for whoever opposes him in the R primary.
