As the Supreme Court nomination/confirmation fight looms on the horizon, let's not forget the agreement that was wedged together by the now infamous gang of 14. With 55 seats in the Senate and 7 Democrats who have entered the agreement to not filibuster nominees in cases other than 'extreme circumstances'... the current fight is much different than it would have been a few months ago.

Assuming that the President chooses a nominee that does not have ethical, character, or competency issues, he should get all 55 Republicans to at least vote to end any attempts to filibuster the nominee. Assuming this, the President needs only 5 of the 7 Democrats who signed the deal to hold true to the deal. IOW, he can lose 2 of the Democrats and still get the nominee through.

On the flip side... the nuclear option is still a looming possibility that would require only a majority vote (or 50 votes + Vice President Cheney's tie-break). So in that case, the nominee could get the floor vote if only 2 of the 7 Republicans decide to back the nuclear play in light of what they feel is the Democrats breaking the deal.

How can you assume anything agreed to by the dems will be lived up to? Lets also not forget collins and snowe are dem whores who sold out long ago so now you're down to 53.Mccain will only do what's good for him. 52. now what?

There are more pubbies than just those 7 who are in danger of doing what the NYT tells them to do. The 7 did not include Specter, for example. The Dems will force Frist to the nuclear option, but I don't know if the Pubbies have the huevos to win that fight. There will be 2-3 months of sustained pressure by the front page of the WaPo and the NYT, and the Voinovich's and Grahams of the world just won't be able to withstand it.

It will take a strong effort by Pres. Bush personally to win this battle. He'll have to perform a lot better than he did on the Bolton nomination. I'm not sure he will. This is one of those things that requires arm twisting, not "aw-shucks" good sportsmanship.

Two solutions--constant huge constituent pressure on the existing Senators--and if they don't do the job, FIRE them and hire some new people.

Much more than vitamins but he did have his illness and pain which were pretty much covered up at the time - except for not lifting the children because of 'back trouble'.
