I don't know if there's a specific law about that or not. IANAL but I believe that he would have had to make the statement while under oath to be prosecuted for perjury. My only point was that he wasn't giving sworn testimony when he gave that speech.
As I said, I don't know that kerry has ever made any of his statements when he was legally under oath.
Interesting and thanks
This account seems to confuse Alston with Michael J. Givens:

Kerry took over command of Alston's boat, PCF-94, after a battle in which the boat's previous lieutenant had been injured. Alston was also wounded in that fight, a clean gunshot through the arm.

29 JAN 1969 Cua Lon Rivers
Early in the morning seven swift boats embarked on a mission to destroy enemy installations along the Cua Lon River. While Kerry's boat and another (PCF72) were probing a canal along the river, Kerry's boat came under heavy fire and was hit by a B-40 rocket in the cabin area. One member of Kerry's crew -- Forward Gunner David Alston - suffered shrapnel wounds in his head. His injuries were not considered serious and he was sent to the 29th Evac Hospital at Binh Thuy.

27 FEB 1969 Bay Hap River
On an evening patrol with two other swiftboats, PCFs 23 and 43, about 26 miles south of Ca Mu, the patrol took heavy fire, including five rockets. Three rockets narrowly missed Kerry's boat, and exploded on the opposite bank. Another rocket exploded near PCF 94, and the fifth exploded near PCF 23, wounding a crewmember on that boat. The boats suppressed the fire and withdrew. During the battle, a sailor on Kerry's boat, Crewmember/Trainee Michael J. Givens was shot in the upper right arm. Givens injuries were not serious and he was sent to the 79th field hospital in Can Tho.
Nice work Bandito!

Kerry was not on the boat at this time. It was Peck I believe.
Look at the "fuzzy" (photo-edited ?) object in the background of the first photograph you referenced, and colors the boat colors and arrangement.
It appears that photo (the one with Kerry in an untucked T-shirt and no rank insignia = pretty lousy appearance for AN OFFICER in the Navy with his crew!) might have been taken on a transfer boat or small craft, where it would be reasonable to have several crews mixed together.
Going on liberty perhaps, going to the support craft upriver?
The set of enlisted in the pictures in completely different.
For your reading pleasure
If this is true, the warm and fuzzy's will be all over FR!! Lying Democrats...who knew!
Black male veteran of the cloth...goint to get Al Sharpton and Jesse Jackson all revved up...
Kerry is getting worse than Klintoon with his contortions.
There certainly is something fishy here - matter of fact, it's downright deceptive in my opinion. It's a good blending of bodies into one picture, but the light is obviously coming from three different directions.
Great observation!
The question is - who would benefit from grouping these particular people together? Is the sole purpose to put Alston and Kerry together?
<< Why did the Rev. David Alston put himself into this position of deception and lies? >>
Free lunch.
Free booze.
Free junketing.
And fifteen every-bit-as-unearned minutes.
Hopefully, we will hear about this from the Swift Boat Vets.
If we can get confirmation on this from them, Kerry's massive lies and spins will have taken a massive blow.
The sun is behind the picture taker in that photo. All the subjects are looking into the sun, so the shadows are appropriate.
Kerry does look like a hanger-on in that picture, like he doesn't belong there. Interesting.
"It's personal for me - My father served in Viet Nam, with the 1/5 1st cavalry Division (Airmobile) 68-69. He was never the same, and afterwards he wasn't the same man my mother married."
Your father, my brother in law, several friends and Nam Vets that I barely know were assaulted, spit on and called terrible names on their return from Nam.
At LAX and SFO these creeps would get on the moving sidewalks in the airport and spit on returning GIs going the opposite direction. Throw stuff at them and yell "Baby Killers!"
We have no idea how many of these young men were scarred for their lives due to this.
Kerry, Fonda and the other anti war criminals were responsible for these vile acts.
That's exactly what I thought. The face shadows are consistent with that. Now look again: where is Kerry's shadow on the boat? The shadow of his body might be below the frame, but at least his arm must cast a shadow.
