Cannabis charges against MS sufferer dropped
The case against a wheelchair-bound woman with multiple sclerosis accused of supplying cannabis chocolates to fellow sufferers has been formally dropped.
Kirkwall Sheriff Court heard that Elizabeth Ivol, 55, also known as Biz, was no longer fit to stand trial.
The move came Ms Ivol, of South Ronaldsay, an island off Orkney, was at the centre of a medical emergency.
She was taken to hospital in ambulance after being found unconscious at her home.
Ms Ivol had always said she planned to put an end to her pain by taking her own life once the court case was completed.
Earlier, it emerged the crown was planning to drop charges against Ms Ivol.
She was accused of possessing supplying and cultivating cannabis after police visited her home in August 2001.
In a makeshift court at Kirkwall's leisure centre, called into service because of its disabled access Ivol's solicitor, James McKay told the court her GP had produced a report stating she had become "unfit for any further court appearance". This was due to her MS.
Procurator Fiscal Sue Foard accepted the findings of the report, which was dated June 23, saying that it would be inappropriate for the case to continue.
Speaking at the end of the proceedings Sheriff Colin Scott Mackenzie told the court it was "an unsatisfactory ending to a sad case".
