The population of today is different with different situations and needs, it is not unlikely that there wold be some differences from 1776.
If you want to live by yourself in an island with no neighbors, then you can legally run around naked under the moonlight chasing your dog while smoking pot if you wish. If you are living among other people there is an issue of the equality of all freedoms and there expressions in a populated community. Some see this as civilization and others see this as a flushing of their rights because they can't do any old or odd thing they wish.
