There is no first degree murder or second degree murder under Texas law. There is murder, and there is capital murder which offers the death penalty.

This was not a capital murder, which usually occurs during the course of another specific felony, or requires multiple victims.

The crime of murder in Texas is the same whether it's a premeditated assassination, or a sudden urge to knock someone's head off.

I think that story came from a witness that heard her talk about it at a party.We'll see.

The part about the sex was from a statement made by the girl who called the police with the tip about who the driver was, not by Mallard.

Speaking of degrees of murder -- I was looking at a bunch of N.Y. murder cases last night, and every darn one of them was murder in the second degree! Do they not believe in 1st degree murder in N.Y.?

The Bishop of Phoenix has something in common with this woman, except luckily for him, the victim's dead body was thrown into the road -- not that that's going to help his case. From what I've read, both were three sheets to the wind.

They can get together and commiserate over their legal woes. How nice. The Bishop of Phoenix and a nurse's aid have something in common -- JAIL!

Even something seemingly unreleated to nursing, like shoplifting could result in permanently losing your nursing license.

SOMEONE in a hospital forcibly removed the rings off my paralyzed grandmother's fingers one night. Since she was unable to speak, she wasn't able to do anything about it but cry for several days. I suppose I should be happy she was only robbed while lying there helpless, and not raped...

Later, while she was in a rehab facility, we brought in her favorite neck pillow from home, and someone stole that too.

You bet your ass any hospital employee caught stealing on the outside should be fired! They're not fit for the job.

Nobody but a cold blooded murderer could "perform" while some guy is in your garage dying.

Who, with a victim stuck in their windshield, and being a nurses aide by profession, would first try to extricate the guy on the road, and that failing, drive home with him still lodged in the windshield, drive into the garage, close the garage door, tell the guy she was sorry, go inside, call a girl friend, a boyfriend, etc., without ever call 911 or offering even minimal aid?

Yeh, I can see someone like that "performing" with the boyfriend while deciding what to do.

Ok, you're both right, only I knew I did imagine this! :-) Evidently the witness quoted Mallard in the statement. This article also says that the witness is a hostile acquaintance to Mallard.

In an affidavit, Maranda Daniel told police that she had been out with Ms. Mallard and several other women in mid-February when Ms. Mallard "giggled" as she explained how she had hit a man with her car.

Ms. Daniel also told police that Ms. Mallard "was messed up" on the drug "ecstasy" when she hit the man. The affidavit also quoted Ms. Daniel as saying Ms. Mallard told her that after she parked her car in her garage, she went inside her house and had sex with a boyfriend, leaving the injured man entangled in her windshield.

I don't believe that was *her* statement. If I recall correctly, that tidbit came from the girlfriend who turned Chante in after she shot her mouth off at a party.

So the sex may have been an "embellishment" on the part of one or the other. The boyfriend will testify, though, and I am SURE that question will come up...

I've been thinking about that. What are the odds that she could drive 7 miles by a hospital, police station, firehouse and thru her neighborhood without one person passing and seeing him?

I think it was around 2 or 3 a.m. (dark) and that curve from is somewhat open area (no buildings close by).
