Student in jail for drugs is raped
Gainesville Sun (FL) ^ | June 10. 2003 | Kathy Ciotola

An Alachua County college student in jail on marijuana charges was raped over the weekend by his cell mate, a man already being held on sexual battery charges, authorities said Monday.

The 19-year-old student was serving four weekends in jail on charges of delivering marijuana, said Alachua County Sheriff's Sgt. Jim Troiano. Last weekend was the first weekend of his sentence.

His cell mate held a ballpoint pen to the teenager's neck at about 9 p.m. Friday and then forced himself on him, Troiano said. A member of the victim's family reported the incident to authorities on Saturday.

Jail detention officers, who check the cells at least once an hour, heard nothing and nothing was reported to them Friday, Troiano said.

Randolph Jackson, 35, was charged with sexual battery. Jackson has been in jail since July on charges of sexual battery in a different case that is still pending.

The two were put in a cell together because they were both charged with felonies, Troiano said. Also, there was very little room in the jail last weekend, Troiano added. There were 918 inmates and the jail's capacity is 920.

"If there was space available, absolutely we would rather keep our weekenders in a pre-designated area," Troiano said. "But because we don't have much space available we have to do with circumstances on hand."

Inmates are assigned to cells based on their charges, their history and other factors, he said.

These two inmates were being held in a two-man cell in pod 1-B. Inmates who are awaiting trial or who don't yet have a jail classification are kept in this section, Troiano said.

Jail officials don't house inmates who are charged with misdemeanors, which are less serious crimes, with those who have felony charges, he said.

Troiano said this was the first sexual battery reported at the jail in the memory of jail officials.

Jackson never showed any signs of having sexual tendencies toward other inmates, Troiano added. He has since been moved to his own cell.

Like I said before, the Alachua county jail is probably not that big of a place and this is an article to garner symapthy for the marijuana dealer, IMO.

So what is your definition of "that big of a place"? The article stated the jail had a capacity of 920 inmates. IMO, that is a sizable county jail.

Not wishy-washy, eh? Then how come people who sell (and sometimes merely just use) plant substances often spend more time in jail than child rapists? ---

Thats the punishement, not the law. The law says not to distribute. I'm not saying it is right or good for rape to occure. I'm asking, how, when you know the possible consequences, can you cry fowl? It's too simple to stay clear of this trouble. BTW, I don't think the law is right, but I know what will happen if I got caught. Life isn't fair you have to be careful.

I thought the term "demon weed" was a clear sign that I was being sarcastic. It seems I was wrong. Never assume anything. Use the (/sarcasm) tag for people like me who actually thought you were serious.

"wouldn't be a betrayal if your kid asked for it."

I don't care if my child begged for it. He supplies drugs, he's toast.

And if this 19-year-old "kid" has sex with your 11-year-old because she "asked for it", you would give your daughter a stern talking to and let his parents deal with him.

Don't look for a card from me this Sunday.

So your claim is that in fact he wasn't raped, because the jail is not that big? Any facts to back that up?

The fact that this jail has twice the average capacity is obviously not one of them..

Right, if you want play games with the system and you loose you pay the price. Rape, no good, but it happens in prison, knowing that alone would keep a lot of folks on the cautious side of things.

Attention Drug Warrior yahoos:

I stand VINDICATED on calling prison sentences for marijuana a cruel and unusual TRIP TO THE ANAL RAPE CAMP.

When it HITS HOME to one of your friends or family members, maybe then you'll pull your heads out of your collective a$$es and realize just how much of an INJUSTICE the War on Some Drugs really is.

Or maybe not, comrades ...

Reality 101: Jail/Prison equals rape and humiliation.

Delivering weed is a definition that could cover half of our college population. Sharing/breaking down baggies/tossing a joint to a friend would fall into that category.

No, I am not condoning drug dealing, just would like to see the details before jumping on the "he deserved it" bandwagon.

i think the legislation of morality, or attempts to, support of etc. are probably just as divisive. i guess the WoD kind of falls under that rather large umbrella though.

You might want to advise your daughter not to smoke any pot.

I have, thanks.

The important thing is that these made up theories can fit Dane's agenda. Facts be damned!

Bad analogy. A 19 year old is an adult -- his parents don't have legal control over him. But for the sake of argument, if a 17 year old boy had consensual sex with my young daughter, I would NOT beat the shit out of him (although I'd be pissed as hell). Why wouldn't I? Because it's against the law, and I'd probably be thrown in the slam. I'd read him - BOTH of them - the riot act, and I'd call his parents and do the same. What else can one really do?

DRUG DEALER.
Provide evidence for your claim.

Oh please. Why don't you provide the evidence for your claim that all he was doing was "toking the demon weed".

He was convicted of a felony. He was a drug dealer. He's scum.

Charges have been brought, which is virtually unheard of in jail/prison rape cases, suggesting there's rather foolproof evidence of what transpired.

Uh dude, learn how to read. Here is the quote from the article.

Randolph Jackson, 35, was charged with sexual battery. Jackson has been in jail since July on charges of sexual battery in a different case that is still pending

Randolph Jackson was charged with sexual battery, but it doesn't say against whom(and not against his pot dealer jail mate).

But you go ahead and believe and perceive what you want. The NYT loves readers such as yourself, iMO.

Yep. And will probably use that money to buy more drugs to deal. I'll bet we haven't heard the last from this guy. He'll be back.

Like I stated before, if the kidnapper and molester in California, screams rape while in jail, I hope you all [sic] (pro-drug [sic] people on FR) are all as outraged to be consisitent [sic].

My views are intellectually consistent. I have long regarded the condonement of prison rape an appalling statement on society, and advocated stringent measures to comprehensively confront the issue. Otherwise, I find it intellectually consistent to recognize that one would express greater outrage at the rape of a nonviolent marijuana smoker than at the rape of a pedophile. Whereas the act itself remains equally abhorrent, the victim in each case induces differing levels of sympathy (the latter generally none).
