When Lincoln and the military refused to honor the writ, Chief Justice Taney in Ex-parte MERRYMAN declared Lincolns suspension of habeas corpus unconstitutional. A single justice can not rule for the entire court. Taney ruled on Merriman as a district circuit judge, not as a member of the Supreme Court. The full court never heard the Merriman case because it was moot by the time they came back into session.
But by your reply, can we assume you support civilian trials for Al Quida terrorists as opposed to military tribunals? Does habeas corpus apply to terrorists seeking to destroy the nation?

It’s irrelevant now. Thank a Yankee.

Constitutionally provided anarchy. Bummer of a detail, that. Did you forget a sarcasm tage? Where in the Constitution is anarchy sanctioned?

Hate to butt in, but how does military tribunals for captured alien un-uniformed terrorist equate to American citizens denied of their Constitutional rights? Don’t think there is any parralell. Just sayin.

So sayeth that wannabe Constitutional scholar, the master copy and paster Chicago Yankee, race obsessed, non-sequitur. Considering your post 151 that's yet another pot-meet-kettle moment. Two within minutes of each other. You're on a roll today.

Nope. Im a Presbyterian.
That makes you a co-religionist of the Puritans then, does it not?
Don’t think so. It probably makes me an Orangeman, much like Andy Jackson.

OBONGO is gay, I don’t call Lincoln gay but there it’s obvious that you are obsessed with gay rights and race. Oh wait, you’re a liberal.

They are both from Illinois, so maybe both of them are gay? Not that there is anything wrong with that.
