The divorce papers would need to use the same spelling as any legal papers filed beforehand. That means that if the incorrect spelling was used earlier, Stanley Ann might have continued to use that spelling when filing for divorce, just to avoid problems and confusion. Who knows?
She would certainly have known how her son chose to spell it when he claimed the name as an adult.
