§ 1401. Nationals and citizens of United States at birth

The following shall be nationals and citizens of the United States at birth:

Sorry, but you're simply making the argument that all people born in the circumstances contained in that statute are US CITIZENS.

There is a fundamental difference between a Natural Born US Citizen, and a US Citizen by statute.

Few of us here are arguing the Obama isn't even a US Citizen. What we are saying is that he IS NOT a Natural Born US Citizen, which the US Constitution requires for eligibility for President.

The problem is that the Constitution in Article 2/Section 1 does not further define who a Natural Born Citizen is and the only legal guidance for defining that term is provided by the 14th Amendment and Title 8-Chapter 12 Subchapter 3, Part 1, Section 1401 of the US Code of Laws. The US Supreme Court has never entertained a case challenging who is eligible or ineligible to be President as a Natural Born Citizen and the current Supreme Court has so far refused to hear any of the cases that have been presented on the issue.
