He can say he never knew. What he has to worry about is a special prosecutor finding a lot of folks and documents (college, passports) that show he knew. He knew and he was just gaming a legal system and Nation he does not believe in.
That's exactly what he's going to do. If this somehow goes through, we can expect a shocked and tearful Obama to stagger to the Teleprompter and tell us that his grandmother/mother/relative of your choice had lied to him all those many years ago.
I'd be surprised if there is any serious special prosecutor appointed for him. The only reason a special prosecutor would be appointed under the Dems would be to find him innocent.
