The family of a high school sophomore has filed a suit seeking to force school officials to allow the girl to wear clothing with Confederate flag images. The federal lawsuit was filed Thursday by the North Carolina-based Southern Legal Resource Center, a Confederate heritage legal advocacy group.
Candice Hardwick, 15, said she wants to wear the Confederate emblem to pay tribute to an ancestor who fought for the South in the Civil War. Latta High School officials say the symbol, which many people consider racially charged, is disruptive in school, and that district policies allow principals to ban such clothing. The teen said she has been forced to change clothes or turn her shirt inside-out. She said she has been suspended twice and threatened with being kicked off the track team.

We sure have been seeing a lot of Mexicans waving Mexican flags stating it is their heritage and are proud of it!
SHe would have no problem wearing a Mexican flag.
Change the shirt to a Mexican Flag shirt and the student would get national support!
She should sue. I hope she wins, and believe she will.

A white girl on the track team, wearing a Confederate flag, in Latta, SC? She must be a pretty good runner, lol, because 95% of her team would be chasing her.
Thats what the courts are there for. Why shouldnt she sue? What if she was prohibited from wearing a cross?
Or a rainbow flag shirt
She's being denied her rights to a CIVIL act, honoring her family, LEGAL residents of this country.
Why not sue?
A kid in Southern California was suspended from school for wearing a tee shirt that said "Border Patrol".
IMO, the only people in this country that are not allowed to be offended are the caucasions. We offend everyone in one way or another, yet our concerns and cares don't matter.
Flame away.
Or Irish, Italian, German, Polish, etc...
I sure hope our kids' kids realize the Constitution doesn't guarantee you the right to never be offended.

When they loose this case, they should be forced to pay for every cost incurred in putting forth this case. Hourly attorney fees for both sides, judges hourly pay, every paper clip, piece of paper, recording fees etc. etc.. And if they don't pay, them make them perform the exact hours of community service to pay it off.
I think a school can set a dress code. It's within their rights as a school. Same as businesses can set a dress code.
This is more of the 'my feelings are hurt' litigation. She suffered no notable damages - she can wear what she wants on her own time and express herself then.
I hope the school wins.
As I said, schools and businesses can set dress codes. That's not too controversial.
This has nothing to do with religious expression, so comparisons to a cross are misplaced.

I'm pretty sure "loser pays" works one way in this kind of case. If the school loses, they can be rquired to pay the court costs, but I don't think the family could be forced to pay if they lose.
