Satam Al Suqami entered in May 2001 on a temporary business visa, which had expired by Sept. 11.
Nawaf Alhazmi's visitor's visa had also expired since he'd arrived in January 2000
Hani Hanjour entered the United States on a student visa, but became illegal when he didn't attend school. Five months after the attacks, an Arizona flight school received word that the government had approved Hanjour's student visa.
Here's the deal. There were at least 5 sources that said they had positive ID of Atta being in the country like 18 months before INS said that he was in the country. But the 9-11 commission said they weren't going to consider those because it was impossible that he could have been here then because the INS said he wasn't here until 18 months later. It was a freaking joke. Like INS had a clue who was coming and going. But to answer your question, he was illegal until he was legal. He wanted an HUD loan to buy a crop duster.
