This issue is not one of legal precedent but one of social norms.

Citizens who vote can decide for themselves. So far it appears most voters come down against medical mj or any other kind of mj use.

Where does it appear that way to you? So far eight states have had a referendum on medical marijuana and all have passed it with large majorities. Name one state where a referendum on medical marijuana has been on the ballot and been defeated.

Wouldn't you say that obeying the Constitution and holding government officials to their Oath of Office is a bit more than legal precedent?

Medical mj has been passed by large margins in both red and blue States. AFAIK, it has never been voted down by popular vote.
