I just don't believe the family could be responsible for Elizabeth's disappearance. I could be wrong, but if nobody can show a legitimate reason for me to believe it, I wont.

fact: father of victim had an unusual relationship with known excon and used tax-avoiding and illegal means to pay off that same excon.....

What exactly is illegal about paying a person for work performed the way Ed paid Ricci?

As for it being tax avoiding, maybe Ricci is considered contract help, and therefore responsible for reporting his own wages.

for the record, I think more things should be done by barter .....

but the point is is that one otherwise proper citizen was probably paying under the table....and you know very well that could have gotten anyone of us in trouble with the feds....not that I think its right....but its the dang law..

kind of like smoking a joint..... people may say that it is less harmful that alcohol ( not me!!!) but it is still illegal nonetheless.....

and illegal activity is illegal activity no matter who does it....

you keep insinuating that those that look at all the characters in this case including the Smarts have some kind of money envy....you don't have any idea who you are talking to but I would suggest that most here are pretty finacially stable...

maybe you aren't....and that is why you are making it an issue....

I'll take issue with you on that, Palladin...

I find Lois's behavior to be very proper and respectful, and have never found her glib or wanting of all this attention....at least she didn't put her dtrs thru little girl tease shows like the Rams.....IMHO....anyway

yes , ED is over the top.....

But as far as I know, the Smart's have never quibbled over cooperation with the cops...at least that I know....the Rams were barriors from minute one and still are , that is why I suspect them..

I don't think there is anything illegal about paying a guy for work,,,but don't social security taxes have to be paid when someone does a certain amount of work...don't you remember the big bruhaha about the rich congressmen who did not pay SS taxes on their nannies.....

I think there is up to a certain amt. that you can pay but after that you must pay SS taxes....

also, someone mentioned that it is against the law to not transfer the title in a reasonable time....here it is about one month....did Ed actually use the jeep as barter or was it more of a dangling carrot where he promised the jeep but kept legal ownership over Ricci's head...

POINT IS.....Ricci is a career criminal and Ed is not...but I think ordinary folk , like us Po'folk that envy the rich...Po's folk like us would not get away with some of the manuevers that Ed did....

Fair Labor Standards Act

Passed in 1938 and amended several times since, the Fair Labor Standards Act (FLSA) essentially ensures that all workers covered under the act are entitled to the minimum wage of $5.15 per hour, and overtime at a rate no less than one and one-half times their regular rate of pay. Overtime is applicable after 40 hours of work in a workweek. While this seems fairly straightforward, some important points and exceptions need to be noted:

Contractual criteria: First, it is important to realize that the FLSA applies only to those employees that have an established relationship between employee and employer. Simply, this means that a contractor relationship between a business and an individual voids the application of the FLSA between this type of worker and the employer. However, regarding the application of the FLSA be aware that the courts have taken a fairly liberal view as to the establishment of an employer-employee relationship. There are no criteria in this determination. The courts have tended to look at tests of "economic reality" rather than "technical concepts." Hence, be very careful when hiring contract labor to ensure that the relationship meets the proper tests. The IRS has excellent documentation to this regard.

You make some good points in distinguishing the Smarts from the Ramseys.

I also suspect the Ramseys; I have suspected one of the Smarts in the past, but I do not now suspect any of the Smarts in this disappearance.

Another glaring difference btw the Smarts and the Ramseys is the way each family dealt with their 9-yr-old child who was a witness.

B/F someone jumps on me and says Burke was not a witness, let me say I am using the word "witness" in the sense of, a person who has information to tell regarding a crime--not an eyewitness, necessarily.

I distinctly recall that when the Ramsey 911 tape was enhanced, they said Burke could be heard speaking in the background. I think he was saying something like, asking "but WHAT did you find??"

I also distinctly recall that Burke was not made available for anyone to interview until he was subpoenaed. Someone correct me if this is wrong, but I really don't think the police or anyone had access to Burke until a long time after the crime.

OTOH, we have heard from the police themselves that Mary K. has been available to be questioned from Day 1. (Oh, wait, I forgot--the police are part of a Big Conspiracy with the Smarts...oh, well...)

Cherry, I'm sorry to continually argue the point about Ed's presumed tax evasion with you, but I just don't believe anyone in the public has enough info to reach that conclusion. That's just my opinion, and in my mind, I have strong evidence to support my opinion that there was no illegality on Ed's part, in the payment arrangements for Ricci. I am not so sure there was no unreported income on Ricci's part.

I now see that Trussell has also provided some data on the rules that would presumably apply to Ed's arrangement with Ricci, and I think we shd take her info into account, too.

Thanks for providing the FLSA information. I found its discussion of the difference btw an "employee" and a "contractor" to be helpful.

Seems there are a hundred different situations in which one needs to make that determination--was someone a contractor, or an employee? I think that's why we need to focus on what the particular situation was in THIS case, and your post is helping us to do that.
