True. But now he is a murderer with a death sentence, and will be on death row. The ironic thing is, that one of the safest places to be locked up in CA is in San Quentin's Death Row. Not one unexplained death in over 40 years. Contrast that with San Quentin's "normal" death rate of one unexplained death (on average) every 3.4 days.
