I wasn't going to respond to your #275 directed to me, but in light of your additional #293 I will. I don't know when you came in on the DW debate, but I had been in on it from the beginning. If you read my posts, you'd know that I was quite critical of the VD's & open to the possibility that they might have been involved. I eventually came to the conclusion that DW was guilty from the evidence that came out. It also became obvious to me at some point that those declaring the evidence wasn't there to prove DW guilty had in fact become emotionally and socially invested in declaring DW's innocence, regardless of the evidence.
It is quite wrong to state or imply that the fault at FR was all on one side. It wasn't. And it is quite wrong to indicate that people on your side had an open mind and that people on our side did not. The bad behavior that you describe was at least equally prevalent on yours.

Hell's bells, isn't that exactly what we witnessed in this trial? Sure looked that way to me! There it was. On COURT TV, in the internet, all being shown that the JURY, in one of the HIGHEST LIVE COVERAGE cases EVER, that the JUDGE refused, after repeated requests by DEFENSE, and by the JURORS themselves, to sequester the JURY in order to ASSURE they would be INFLUENCED by the BIASED case being presented by the media, to assure DW had a FAIR TRIAL by JURY, that the jurors would not be influenced by the media while the trial was on.
The JUDGE said he wouldn't allow photographs of Daneille to be displayed in the courtroom during the trial, as that would be unfair influence on the Jury.
Then he allowed them to have pictures on display during the whole trial.
The Judge said he wouldn't allow the MEDIA and CAMERAS to turn the courtroom into a CIRCUS.
Then he allowed cameras in the courtroom and acted as MASTER OF CEREMONIES for the CIRCUS, using FACE TIME to promote the PADRES every darn day. The final coup of the CIRCUS was the MUSIC VIDEO.
All I can say, is that from all I have seen and heard, and all the evidence sifting and reading of transcripts I have done personally, If Feldman doesn't appeal this, then I would have to believe that DW did commit the crime.

"completely insulting" to delete #293 & #294? Come on, Kim! Bit of an exaggeration. I didn't read #294 but did read 293. I agree I've seen worse things said (in fact, worse things said about me on the DW threads) and not get deleted when I thought they should have been pulled, but I suspect the Admin. moderators have long been fed up with getting trashed by the DW-is-innocent folks. Personally, I don't blame them for having a short fuse.

Yeah, but that's not why I ate crow. I ate crow 'cause I was a little too emphatic and didactic in my response. A little too wound up about it all. Generally, I try to err on the cheerful side. Just a long day at work today! :)

Hmm, you're right about the prison guards. Re "Also, parole boards seem to get it wrong more often than not," DW would be getting life without parole, wouldn't he, if he weren't getting the death penalty? Not sure how it works in California.

Dahmer turned down being in protective solitary confinement. I think he wanted someone to take him out.

Well, it certainly makes sense from a state budget POV, that if you're not going to actually execute DP sentences, you should abolish the DP and do away with a very expensive white elephant appeals system, not to mention the seperate housing and extra security. Good point. But I seriously wonder whether the liberal element that opposes the DP considers the cost of the DP.
But I'll look on the bright side if they manage to strike it down. (BTW, I voted FOR the DP when it came up on the ballot here in California ... although it was a long time ago).

If I may mediate, I think you're both right. Joe's saying that innocent people would generally want to clear it up. And Connect's saying that not testifying isn't proof of guilt. As a practical matter, the first thing is true. That's why juries are specifically *instructed* not to hold it against a defendant that he didn't testify: because the natural human inference would otherwise leap in.

Sentencing hearing will be on November 22. Am I correct in assuming that Westerfield will have the opportunity then to address Judge Mudd?

Red, DW certainly will have the opportunity to speak.
In federal court, victims now have a statutory right to speak directly to the court. I don't know what the law is in California. One would hope they have a good victims' rights law. I just don't know.
Let's see if Amore knows: then he/she can be your very favorite attorney!
