Letters to judge opened to public
|
August 14, 2002 The judge in the trial of David Westerfield today allowed reporters to see court log entries of notes from jurors, as well as letters to the judge from the public about the murder of Danielle van Dam. The letters from the public included a variety of theories about the case.
One letter-writer sent the following theory to Judge William Mudd: "Danielle van Dam killed herself.'' A nearly illegible postcard with a Spokane postmark alluded to at least one ex-wife "with a drinking problem (who) lives in Spokane.''
The postcard was unsigned. Another missive came from a man who referenced another high-profile murder trial that of O.J. Simpson. "The O.J. Simpson case was a miscarriage of the state's justice mainly because Judge (Lance) Ito was too lenient with the actors defending O.J.,'' the man wrote. There was no news Wednesday afternoon about the status of deliberations, but Mudd announced he was holding a sealed hearing 9:30 a.m. Thursday to consider an unspecified defense motion in the case. Wednesday was the fifth day of deliberations. The prosecution concluded its closing arguments last Thursday. Westerfield is accused of kidnapping 7-year-old Danielle van Dam from her Sabre Springs home and killing her. He could face life in prison or the death penalty if convicted of murder with special circumstances. He has also been charged with misdemeanor possession of child pornography. The log entries show that on Friday, the jury requested ``all available evidence of pornographic images'' and a photograph of a teen-age daughter of the defendant's ex-girlfriend.

I think KFI likes what they're doing and is encouraging it.
No, remember Shen saying in twnty days she didn't have enough time to compare some fibers. She did nothing for twenty days after looking at the fibers under the microscope. And the defense didn't even get access to most of the evidence until the trial was under way. It is a prosecution stall strategy.
But regarding the speedy trial, once defense realizes LE is falsifying evidence, every day that passes is another day that prosecution can use to fabricate or destroy evidence as necessary, and get their story straight, and eliminate inconsitencies. Once the evidence is disclosed, it is frozen, and they can't alter it anymore because it is a matter of public record.
BOY. Did you ever RING A BELL!
How simple it would be to keep a TOOTH in the ole pocket, and then take it out when you need it and rub it on an area.
That spot on DW's jacket was probably just another on of the spots he left of his own blood. Someone rubbed a tooth on it real quickly and BINGO!~ Danielle's DNA. No one would even know!
I'm hoping someone's been reading these threads :-)
Jaded is looking for where this info came from. Do you know/remember? I can't find it. I remember Feldman talking about Danielle having a scratch on her ankle and Doosuck Objecting quickly. And I don't remember when that was, even.
Sorry it took so long to get back to you - real life and all that... It was another obscure Babylon 5 reference - Ambassador Kosh in the episode "Believers."
OK, OK, I'm a geek.

Had to spread those orange fibers around, you know!
And the tooth.
Up front, or on the side?
The other testimony has been left cuff....they never did specify tho wrist or leg...so maybe it was the ankle.
If so, why didn't Feldman directly ask that of the tech?...and would it make a difference in the scheme of things?
Dusek was probably objecting to Misstates the Evidence..or just cuz he liked to hear Mudd agree with everything he said.
