SAN DIEGO, California (CNN) --A San Diego jury began deliberations Thursday in the trial of David Westerfield, accused of kidnapping and killing 7-year-old Danielle van Dam.
The panel of six men and six women adjourned for the day without reaching a verdict. It is set to resume deliberations Friday.

This trial .....the Van Dams bother me BIGTIME!!
As a parent who tried to protect my children to the nth degree.....I'm just so angry at their lifestyle, and their in-your-face attitude.
..I can't even imagine a parent coming home from an evening out, and not checking on the children.
...I can't imagine seeing my alarm light on, or a door open, and not immedicatly checking on my children.
I believe them to be fabricators of the highest order!!.....
..and there's more here than meets the eye.
And one more thing!!!!
..No matter how many times they locked that garage door, so the kids wouldn't surprise them during their sex romps.....
...are they daft brained enough to think, eventually, someone wouldn't blab????
....that those poor kids would hear embarrassing things at school??????

Everyone, it seems, in the media, has not only found Westerfield guilty.....they are eagerly looking forward to his execution.
Yes, he might have done it..........but there are so many holes in this story.........
...OK, rant over.....needed to get that out of my system.
And, for the most part, I have found much needed clarity here on this Thread.....and much logical thinking!!!

From watching this trial, I have grown to appreciate our judicial system. Both parties have to establish facts/evidence via regimented rules and approved by the court. THEN, decided if relevant by a jury.
This mechanism gets rid of most of the noise. Can you imagine if our talking heads or even our political prostitutes had to abide by this?

hmmm, no. I was not addressing the instructions at all, just Dusek's propensity for objecting during Feldman's closing.
btw, I appreciate your input to these threads. So few from your 'side of the fence' have the maturity to argue intellectually. Most seem satisfied to hurl invective and absurd lies ala spolied children. You seem to have an appreciation for facts, evidence, and testimony. That being said, you interpret a lot of things differently than I do, but at least you back them up with thought and logic. Enough of that though ...
As to the instructions, my reading is that re: the 'child porn', if one single juror thinks that a particular image is not unequivocably child pron, then it is not. Ergo, all 12 must agree to make it, legally, illegal porn. I think that is unlikely to happen, hence my thought that the 'child porn' charge is a lock for acquittal.
I still think one or two jurors will feel compelled to vote guilty on the kidnap/murder charges, due to the tainting from the media, the porn (real or otherwise), and the judge's not-so-subtle leaning to the DA side. So hung jury is likely, but the DA's office probably doesn't have the stones to retry DW. Pfingst will be hoping the public forgets the whole sordid episode, and Dusek will try to land a job with his fans on CTV, only to find out they think he is intolerably dull also.

This isn't directly relevant to the Westerfield case, but is another example of what "pull" can get you.
In the city I last lived in, there was a really nice waterfront area. Kind of secluded, but you could go fishing there, there were geese and swans to feed. Nice place.
The local (male) homosexual community started using it for their trysts. Since kids were still going out there to fish, the police got complaints, and decided to run a "sting" to catch these guys.
There was a BIG newspaper report about a large group of men (40-50) who had been busted. All of them were going to be tried, names would be released - most of this I think, to discourage any others from going down there. (heh)
After a couple of weeks, there was a
small
article in the paper stating that the police would NOT be laying charges against any of these men - the whole matter was being dropped. And it vanished off the radar screen.
I believe that Someone's son or brother (or maybe just Someone himself - local judge, cop, politician) had been caught in the sting, so all of it was thrown out in order to protect the freak. Of course, the homosexuals still go down to that area, and kids still go there. There was protection for Someone with clout, and no protection for the public and their children.

I've watched a few hundred trials over the years & one can usually get a sense of the system & whether or not a defendant is guilty or not, up front.
I do agree with you about the talking heads and political
prostitutes being held to the same standards. Very much so.

VRWC_minion has DW arrested on Jan. 27 or 28th as well. A Dr. Rodriguez moment? Slow down. No, he didn't.
He said that the first arrests in the San Diego porn ring occurred on the 27th or 28th (a fact which I am not verifying, I hadn't heard that before.) If so, Westerfield hears about it, and begins worrying that he is in line to be arrested for child porn. Either he goes slightly crazy, or figures he'll be arrested anyway, and kidnaps, abuses, and kills Danielle.
It is no crazier than other theories we've posted here, and in its favor, it would finally provide an actual motive for Westerfield - something that seems to have been missing so far. I don't agree with it. Seal or not, if his or Damon's name were on that list, it would already be out there, on every paper in the country. Still, it's not bad.

Locally, an aide to the state A.G. was caught with child porn on his computer (at the office!). So far (as of this morning) they are being slow to name the person, and he has not been fired. Laws are not exactly enforced the same way for all of us, apparently.
