The journal was part of discovery, and the defense did have access to it as such. They did not use it.
So that pretty much leaves only the conclusion I came to before. DHP is either a mental case or extremely stupid, because he committed malicious libel in his public statements and on his website.
The prosecution has no need to introduce the diary as evidence, because it is irrelevant to the case against the defendant, and could arguable be prejudicial to the defendant, i.e. being merely an emotional display of the humanity and innocence of the victim.
