You are confused as to who brings a prosecution a case. Its not the FBI, its a politally appointed ladder climber that doesn't want to take any chances and therefore he isn't going to stick his head out and take a case he isn't guaranteed to win.

Very good point. I got that same impression from their behavior Saturday morning, with Damon's "Oh well, we still have the two boys to raise" and their utter lack of worry. But it might have started on Friday.

i really believe westerfield is guilty and the jury will as well. the absolute clincher for me is the indisputable fact that danielle's blood was found on the right hand side shoulder of westerfields' jacket.

It was not proven to be blood. It was 'presumed' to be blood. The DNA test matched 12 out of 13 markers. The expert said a PERFECT MATCH means that a DNA sample would only match 1 out of a jillion. What the expert DIDN'T SAY is that 12 out of 13 does not constitute a PERFECT MATCH.

NOW, how would you feel if the next day, the SD DA announced that in the films confiscated from the CHILD PORN RING that they just arrested people for (1) on JAN 27th, (2) on Feb 18th (gee, isn't that just a few days after Feldman said that someone dumped the body of Danielle at Dehesa Rd.) that one film contained scenes of the number (2) guy and Damon and his friend from Florida gang raping Danielle. WHAT WOULD YOU THINK THEN?

BTW, have you seen what was alledgedly in DANIELLE's DIARY? The one she was writing in for HOURS according to Brenda and Damon ?

Regardless of the jury verdict, a conviction will be reversed on appeal because a guilty verdict simply cannot be supported by the evidence. The inability of the bug experts to come up with even a possible explanation for the lack of bug activity that could justify a dumping date to early February. This, more than anything, would force me to say not guilty. Damon's suggestion to search closer to town and his trip to the dessert on 2/16, the date Faulkner suggested as the date the body was dumped would lead me to believe that Damon, more than DW, should be on trial.

Damon must realize that if DW is found 'not guilty', the police will have to start looking at other suspects, and he is the obvious choice.

One last question: Don't you have to believe Westerfield kidnapped Danielle to make everything work for a guilty verdict? To me, the fact no one ever proved Westerfield was in the vD house is a big stumbling block to believing he killed Danielle.

That is the question we have asked on these threads since the beginning. PROSECUTION says that DW must have picked them up and carried them with him and Danielle just because he wanted more fiber evidence spread around to make sure he got caught.

Unforunately, no they won't. They will dismiss it as a stupid jury. And David's life, well it has already been ruined. If for some twisted reason they found that the hair under the body matched, say Avila's do you really think that news would make the light of day? I don't.
