The defense contends Westerfield could not have dropped the body where it was discovered because he was under intense surveillance by the police beginning Feb. 5.

SDPD lay in wait for him as of 2/3.

He returned 2/4

As of 2/4 around 2:30 PM David was in their presence for 28.5 hours for interrogation, shower and trip.

On 2/5 they began intense surveillance 24/7.

He was arrested in the late morning of 2/22.

Been in custody ever since.
