All I want is for people who may be innocent, to be given the chance to argue their case. We've seen that the government can act without just cause, as it did many times during the Clinton administration.

The legal premise of Habeas Corpus at least allows an American citizen to defend himself because a charge is defined and leveled against them. The present circumstances has Padilla confined, indefinitely, with no charge and chance to refute the claims the government has made. This is bad precedent, Jim. This allows President Hillary to do this to us.

The Friday Wall Street Journal made three recommendations that would be satisfactory. It would establish procedures that would protect our rights, while still allowing action against traitorous Americans when top secret considerations might prevent a standard civil criminal trial. I'll see if I can find the post.

I need to live in a country where if you are innocent, you can defend yourself against an untrue charge levied against you by the government.

Good points. Did you notice the article on Drudge about how even some Justice Dept. attys were having some trouble with how they were handling the Jihad Johnny case. parsy.

I gotta question to you both... (I am not Ex-Military, so I have to ask)... is there any established criteria, in War, for separating Traitors from Enemy Combatants?

It's actually an important question.

Jim, you're a veteran, and I am just asking a question -- who's a Traitor, and who's an Enemy Combatant?
Are there ANY protocols, or do we need to write some?

By the way -- Unless I am mistaken, Congressman Ron Paul did NOT authorize any "war". Rather, Congressman Ron Paul said that the only way to avoid a horrific Constitutional FUBAR was to formally declare War... otherwise, we have our Nationalist Heads up our Constitutional Arse.

Incidentally, I am NOT some anti-american Communist who traitorously disapproves of War against those who kill Americans.

I am in favor of War against those who kill Americans.

In fact, I agree with Ron Paul -- formal War is the ONLY Right and Constitutional way to do a Federal Military war-Operation. (anything short of War is grounds for Marque and Reprisal).
