Why are you dumping on MAF? She's MUCH brighter than you.
I am trying to find the context now.

The legal premise of Habeas Corpus at least allows an American citizen to defend himself because a charge is defined and leveled against them. The present circumstances has Padilla confined, indefinitely, with no charge and chance to refute the claims the government has made. This is bad precedent, Jim. This allows President Hillary to do this to us.
The Friday Wall Street Journal made three recommendations that would be satisfactory. It would establish procedures that would protect our rights, while still allowing action against traitorous Americans when top secret considerations might prevent a standard civil criminal trial. I'll see if I can find the post.
I need to live in a country where if you are innocent, you can defend yourself against an untrue charge levied against you by the government.
BAD idea. I have friends that lurk here and don't post, but log in so they can see pings to them.
Yeah,Reagan really screwed-up there. Don't tell me,let me guess,ok? You "think" (ROFLMAO!) this is a GOOD thing,right?
Because under a Bush administration, the maggots are Padilla; but under a liberal Democrat administration, the 'maggots' become us.
But I DO support us while we are at war!
But why shouldn't we say we don't like what the administration is doing?
I thought it odd that the Homeland Security thing was ready so quick. I still do.
Yes.
Small claims division?

Respectfully, I think you have just been confused by his removal from civilian to military authority. Maybe you're thinking of the denial of h-b because he was moved and no longer in the venue it was filed earlier?
AFAIK his h-b from the military jail has not been ruled on.
I don't think anyone is "going to bat" for padilla as such.
The precedent is a little scary though.
Do you remember Oklahoma City? Everyone went bonkers after that..
They were blaming "the Right Wing" "Right Wing hate radio" and on and on with "Right Wing" this and "Right Wing" that.
I don't think it's taking up for the guy as much as people asking themselves if this could ever happen to them though they are innocent. It's probably merited in padillia's case, but the "probably" makes people wonder.
It makes me wonder..
I didn't. Short term memory problems?
They file the papers, they pay the money, and they become citizens without being deported and obtaining a visa to immigrate here. It amounts to the same thing. It is awarding criminal conduct and encouraging more of it.
