That's totally irrelevant. A request to waive diplomatic immunity and extradite a diplomat can me made at any time. I don't think the State Dept. wants to waive diplomatic immunity for what's on an electronic device. A foreign spy agency could have hacked the device, as they would have an interest in doing so. Sounds like they got the guy out of the U.K. to minimize the embarrassment.

Once the perpetrator is back on U S soil we're no longer talking about a diplomat with diplomatic immunity, so there is nothing to waive. If the Brits want to have him returned to the UK they would have to issue a warrant for his arrest and request extradition. Waiving diplomatic immunity needs to be done while the perpetrator is still in the host country.
