Someone described these sorts of policies as business abortions. While the original article I read years ago had to do with penalties for closing factories, the point was made that when someone is planning to open a business, he takes into consideration the risk of loss if the business is closed. If the risk is too great in one location, he will choose elsewhere.

We do not know how many businesses did NOT open here because of excessive labor and environmental regulations, and high taxes. The author referred to these as business abortions. These are businesses that never saw the light of day because the situation wasn't right. If closed supermarkets get additional financial penalties for being empty, you'd be a fool to open up a supermarket.

Years ago, downtown Rockford, IL (south Main Street) was deemed a food desert. There was one "madre y padre" Mexican store that did just fine. They were forced to sell because the city thought the area would be better served by plopping a big box IGA next to it. The city actually SUBSIDIZED the big box store. It failed in under two years, when the subsidy ran out I imagine. It is now back as a "La Chiquita" market, with a Family Dollar next door. The city management failed. Enterpreneurs instead build what the neighborhood would support. The "La Chiquita" store succeeded because the original capital expenditure was absorbed by the losers.

so if he had his way, a business is supposed to operate at a loss ,,and absorb all the shrinkage, and security costs, and other costs involved with operating in a bad area.

And if a business decides to opt out, then they will be punished with this tax.

I just don’t understand the mindset that would come up with such an idea. Well, even in liberal San Francisco, they’ve put this idea aside for now.

A punitive tax intended to force a desired commercial property use that the owner would not have normally chosen has been found to be an unconstitutional 5th amendment taking in the past.
