If that’s the case, if the 13 YO is the father, he might still be in legal jeopardy.
The only available evidence (from the article) suggests the 13yo boy as the father. If the father is someone else, more than 24 months older than the girl ... then it’s a different matter.
As much as some people find it distasteful, paternity testing should in general be mandatory at birth.
