The legal definition of statutory rape in the Great State of Mississippi. Read carefully ... a 13 year old engaging in intercourse with a 12 year old, however reprehensible it may be, does not fit the definition. It completely fails under (1)(a) and also fails per (1)(b)(ii).

Absolutely. It’s not statutory rape. It’s only unfortunate they weren’t a bit more mature in this day and time. Apparently the family is supportive and that is good for their child. Nobody knows how it will all turn out in the end. Truly glad they weren’t forced by their parents to kill the child. Thank God for that.

(1) The crime of statutory rape is committed when:
(a) Any person seventeen (17) years of age or older has sexual intercourse with a child who:
(i) Is at least fourteen (14) but under sixteen (16) years of age;
(ii) Is thirty-six (36) or more months younger than the person; and
(iii) Is not the person’s spouse; or
(b) A person of any age has sexual intercourse with a child who:
(i) Is under the age of fourteen (14) years; and
