Federal law doesn’t require your written consent. State laws vary. But nothing stops you from asking. If the answer you get sounds like a shrug, that’s your answer. Good doctors welcome the question.

Recently the SDNY ruled in US v Heppner, that using AI chatbots voids attorney/client privilege. I can’t imagine if that holds upon appeal, why HIPAA requirements aren’t similarly impacted.
My GI Dr same. In there I see ‘her’ more than once. I’m a he.
Using a cloud based (ChatGPT.com) like services to do this does introduce HIPAA questions.
That said, if a facility has inhouse LLMs to handle it I’ve no problem. Just summarizing a discussion is something AI is very good at. If it means doctors have to spend less time writing and enable more time engaging in actual medical activities, I’m for it.
When physicians and other health care professionals use computers and various programs to generate their notes, it is often the worst gibberish imaginable. Hopefully the actual diagnostic acumen and prescribed care is better than the note.
Not worried. My doctor still uses hand-written notes and charts in a manila folder. :-)
Last time I went to see a doctor the real doctor didn’t even look at me. Face was staring at a iPad the whole time.
