A high-profile killing on a Charlotte light rail train has hit a legal pause after a court filing concluded the suspect is not currently fit to face trial.
Decarlos Brown Jr., 35, has been deemed “incapable to proceed” on state murder charges tied to the death of 23-year-old Iryna Zarutska, a Ukrainian refugee, per the New York Post.
The finding comes from a motion filed April 7 following a mental health evaluation conducted late last year.
According to WBTV, Brown was evaluated on Dec. 29 at Central Regional Hospital. The resulting report determined he is not competent to stand trial at this time.
A judge must now review the report and decide whether to accept its conclusions. If the findings are upheld, the case will likely be delayed until Brown’s competency is considered “restored” by the court

If I remember correctly his mother to her credit tried to get the state to keep him incarcerated. They refused and we know the result.

Some judges are making a case for vigilante justice. If they can’t do their jobs, citizens will have to.
If I am ever on a jury where vigilante justice needed to be applied, I wouldn’t have any problems doing it. No way I would convict a family member of having to remove scum like that pos.
I live in NY State, not anywhere near the City. I worked in uniform in NY's prison system. Retired in 2003. Many years ago, long before I took the job, the State retained mentally ill convicts past their release dates. Eventually some attorney(s) picked up on it, filed a lawsuit against it. The court at the time declared that it wasn't a crime to be nuts, and they were all released. Sometime during Andrew Cuomo's terms as Governor, he signed a Bill that allows the State to retain dangerous criminals beyond their release date. I searched for that specific Bill but was unable to find it.

The states really need to passy guilty but insane statutes and stop the unfit bs.
If they become fit, they can request a new trial, until then they stay in a mental ward for the criminally insane.
