Yes he should have been arrested. But this was NOT a lawful shoot in my opinion.
We have the benefit of 20/20 hindsight and slow motion. Those officers did not. They heard someone say “Gun!” and something was in Pretti’s hand. It is very common for people to carry more than one weapon. It would be very difficult in all of the chaos and the very short period of time for the officers to know that it was a phone and not a weapon. At the time he was shot, Pretti was also reaching towards his right hip and holster, where he could have been concealing another weapon.
It was a shooting brought on by the deliberate chaos the Pretti guy was engaging in.
If you see a cop has pulled someone over and is engaging in an arrest and you get out of your car with a gun on you and enter into the scene with an aggressive and angry attitude, approach the law officers and the perp, you might get shot. People with dangerous jobs like this are always aware that this day could be their last when dealing with law breakers and criminals.
