“The requirement of being “under the jurisdiction thereof...” must be clarified before the birthright amendment can be applied. The Constitution itself does not do that. It is not the job of the Supreme Court; it applies the law, it does not make law. The Congress could clarify by statute, but its had 150 years to do that - but hasn’t. It therefore falls to the President to define “jurisdiction” through executive order.”
