Stop, stop, stop with Obama. No one is using him or his administration as guideposts of judicial rectitude.

As to Lincoln, his action was questionable at best, but at any rate, in the case Ex parte Milligan (1866), the Supreme Court that ruled that the use of military tribunals to try civilians when civil courts are operating is unconstitutional.

So yeah, if you want to trash our Constitution, have at it.
