Constitutionally, Tariffs are clearly a Congressional
Power. Diplomacy and negotiations are clearly an executive power. When Tariffs are used for times of war, or against unfair attacks against US necessary industries, the SCOTUS has already spoken to this in the 1800, clearly given the Executive the right to enforce the law and protect Americans.

The lower court is very wrong, as well as the Tariff court. The POTUS must be allowed to negotiate these types of deals, because Congress has no apparatus or ability to do so. Further, the prior rulings by the SCOTUS have placed most of the Tariff power with the POTUS. The single thing that resulted in the delegation to the Executive was the Amendment for income taxes. The Federal government isn’t ‘funded’ by Tariffs, and they are essentially used for diplomacy. Thus, it’s really in the court of the Executive.

The answer is relatively simple, if the courts have an issue, and that the final trade deals should be voted on by Congress.
