“Shot to death” is correct so long as he died from the gunshots, even later. If the term used were “shot dead” that would indicate he was dead when he was found.

The presumption it is them. The presumption can be rebutted only by clear and convincing evidence that it is not them.

It’s OK to presume it is them because usually it is and the presumption may be rebutted.

But jail doesn’t allow people to pretty themselves up for mugshots.
So conclusions based on mugshots about which social class they come from or what their home life is like aren’t worth much.
