This argument alone won’t do the job. Legislative history and intent must be considered. Quite simply, the amendment was intended for freed slaves, not for granting citizationship to children of invaders or to create a birth tourism industry.

You have to look at intent of the authors of the 14th Amendment, which was to prevent the Southern states from denying citizenship rights to the freed slaves. That was understood. The 13th Amendment forbade slavery and involuntary servitude yet we had a military draft during the World Wars and in the Cold War era until 1973. The draft is involuntary servitude but the Supreme Court at that time did not agree that the draft violated the 13th Amendment.
