The diktat wasn't for branches of government, it was for citizens. Their exemption, as citizens, makes it null and void.

Members of Congress would be subject to the same diktats as citizens of the states they reside in as every other citizen in that state would be.

It was supposedly a HEALTH mandate and having even one group exempt from it means all others would be exempted from it.
