Can the Military Enforce Immigration Law?
Center For Immigration Studies ^ | 26 June 2025 | Mark Krikorian & George Fishman

Excellent written summary, plus Podcast - "The Insurrection Act allows presidents to deploy federal troops not only in cases of insurrection but also when federal law can't practicably be enforced through conventional means. The Posse Comitatus Act, which many point to as preventing such a use of troops, is not the obstacle many assume it is."

Text from the CIS link:

"Immigration enforcement today:

(1) The president is unable with regular forces to implement laws of the United States:

(2) More than 15 million illegal aliens are in the U.S.

(3) 3.6 million backlog in immigration court.

(4) 1.4 million aliens have final removal orders, yet remain at large.

(5) Millions of removable aliens were released by the Biden administration, and ICE has no knowledge of their location.

(6) ICE has only 6,000 officers to manage enforcement nationwide."

“2) More than 15 million illegal aliens are in the U.S.”

Oh please. Try at least 30 million and don’t for a minute believe they want to get rid of them. They’ll eventually call for amnesty.

” This act, often referred to as the “Reagan Amnesty,” allowed undocumented immigrants who had entered the United States before January 1, 1982, to apply for legal permanent residency if they met specific requirements. These requirements included continuous residence in the U.S. since 1982, good moral character, and the payment of application fees and back taxes. Approximately 3 million undocumented immigrants were granted legal status under this program.”

Weak but a National Chamber of Commerce dream.

Yes it can be construed that the military can be used to enforce immigration law and policy. Just remember though that once that genie is let out of the bottle how do you put it back? There may come a day when use of the military might be construed as allowable against an issue we hold near and dear.

As I have posted before, Trump should create a Border Guard under similar organization as the Coast Guard. They would be DHS in time of peace, but could be placed under the military in time of war. Just as he did with Space Force, he could transfer personnel and funds from existing organizations. Space Force was carved out of the Air Force, and Border Guard could be carved out of the Army, ICE, CBP and other organizations.

It’s not law enforcement. It’s defense. Invade a foreign country and you are subject to the law of war, not civil and criminal law.

Biden, or his staffers, set up an invasion of our country over an open border.

Weak but a National Chamber of Commerce dream.

How does the CoC view the wave of communism that is about to hit? You know where communists cities and states charge a wealth tax on your international holdings if you do business in their jurisdiction which probably includes the doing business of upholding warranties and product liability even if you think you are going to cease doing business in those jurisdictions.

Or did these economic geniuses think no further ahead than the myth of cheap labor.

There is no immigration law. There are immigration policies implemented by the current administration.

The Reagan Amnesty is still in force...

I have not checked recently, but every year, a couple thousand more illegals get a Green Card.

The Reagan Amnesty was passed in 1986.

Forty years ago!

And, still churning out new Democrat voters, every year.

“Biden, or his staffers, set up an invasion of our country over an open border.”

The Democrat Party swung that, Biden was just their hammer. It’s the only way they will win an election anytime soon after throwing away much of their base to please small radical one-issue minorities and illegal aliens.

US Constitution

Article IV; Section IV:

...The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence....

That should cover both illegals, and transtifa.

...and yes, they have been used on U.S. soil in the past to suppress insurrection in the past. Check your local library (or Google) for verification.

Isn’t preventing invasion the first and most important role of the military? Some would argue it’s the ONLY role of the military.

If the nation gets worse after removing illegal invaders and usurpers, then it would be what Americans voted for.

I have no idea how many illegally here have been allowed to vote or be used as a vote or as a stat to pad the seats of some of the worst blue states in this Republic, but if millions of people leave, and poof, blue states start losing House seats, maybe America will actually be seen as a place where real Americans have had their vote and Sovereignty diminished greatly because of foreign illegals and invaders for years.

And maybe the Military is the only way to corral millions of people out that shouldn’t be here.

Enemies foreign and domestic should actually mean real people who are domestic and foreign enemies.

"There is no immigration law. There are immigration policies implemented by the current administration."

Are you serious or sarcasm? Look up: Title 8 US Code; Subchapter 1300. There are very strong laws against this illegal invasion. Trump is only enforcing them.

It can run detention centers, do processing and provide security/transportation for deportation.

Actual street arrest? No.

But it can free up officers to do that.
