I think I might be the only person on this thread who realizes that NONE of the Trump Administration lawyers actually voted for Donald Trump.
Every one of these hearings and trials should be ringing with memorable and compelling Conservative legal arguments.
Instead - nothing but pitiful silence from career, Hard Left, government employees.

My understanding is the original order prevented him from being deported to Guatemala, not his home country of El Salvador.
If that was the case there would be no problem now.
I do know that he claimed his family moved to Guatemala to try to escape the rival gang 18 but they followed him there. But his citizenship is in El Salvador so that is the country immigration law prescribes for his deportation.
Judge Xinis needs to be schooled about the origins of these Latino gangs. When there was unrest in Central and South America (the Obama-supported communists at work) a lot of people from there came to the US, and especially to California. But they didn’t integrate. My former next-door neighbor had a white American mother and a Hispanic dad and she told me that Hispanics are the most racist people you’ll ever find, and very proud of that fact. And everything I’ve seen seems to support that. So the young male Latinos sought out each other and created their own version of “family”, where you showed your loyalty by committing heinous crimes that would cause others to fear the group - giving them machismo and “respect”. Other racial groups did the same - blacks and Asians. Their members followed their own “laws” and cared nothing for the laws of the American society based on the sanctity of human life.
When the violence subsided in their home countries these kids were deported back to their home countries where they continued their ways and grew both in size, violence, and influence with law enforcement and government. They pretty much took over in those countries and kept their presence in the US as well.
Simply deporting these people does not fix anything, either here or there. It just spreads a cancer, if the countries they are sent back to are corrupt and fail to understand the seriousness of the situation. These are people who have voluntarily seared their consciences so they are not able to feel remorse. They are literally humans who no longer have the ability to be human. Bukele and Trump both know this. To genuinely end trans-national gangs and cartels you have to have cooperation between the countries involved, where if these human animals are found in one place they are NOT just released into the wild in another country.
Judge Xinis wants to upend all that cooperation by letting the transnational gangs and cartels know exactly what the agreements/arrangements are so they can evade law enforcement measures.
When this story first broke the media all claimed Abrego Garcia was this wonderful dad who was taking care of special-needs children, including 2 who were not his own. Now we find out that he was abusing them and his then-girlfriend (now wife, who he married when he thought it would increase his chances of being able to stay in the US) and that the kids who are not his own were legally sought after by their biological dad who didn’t want his kids in the home of a ruthless gang member. The idea that this is a “nice guy” who just happened to be hanging out with known MS-13 members while looking for employment is absurd. If MS-13 heard of one of their own being accused of being a “nice guy” there would be trouble - unless it’s all a lie to subvert the law and keep the group in the business of extortion and killing. And that is precisely the lie that both his now-wife, the media, and whoever is paying the bills of the attorneys are pushing. The fact that the guy got a symbol for MS-13 tattooed onto his knuckles at the very time that the govt knew he was MS-13 but wouldn’t deport him is a big middle finger to the system he was milking.
Judge Xinis is WAY, WAY overdue for an education.
That would explain what we’re seeing. When the media doesn’t tell us what the government arguments are it’s hard to know what’s going on exactly, but it makes no sense to me that they are not reading aloud the actual statute governing withholdings, now that Xinis has made this about something other than how to “facilitate” Abrego Garcia’s return to the US - something that could only be done through an extradition agreement which would require the US to officially charge Abrego Garcia with a crime. And even then, US justice would have to wait in line after El Salvador’s justice so it wouldn’t be happening anytime soon.
Unless they are making these arguments and the media is just hiding it and Xinis ignoring it, your explanation would explain it. Only thing is, it’s said that the Solicitor General is supposed to be solid. I’m not seeing it though. Of course, Xinis keeps coming back to the attorney at first who said the deportation was a mistake. I think that attorney has been fired, most likely because he was out to sabotage Trump.

IV. Conclusion The Respondent's application for asylum is time-barred without exception. However, he has established past persecution based on a protected ground, and the presumption of a well-founded fear of future persecution. You are absolutely right. The withholding was that he couldn’t be deported to Guatemala, where his nuclear family was living at the time. However, he was deportable to El Salvador because he had not proven that the government would torture him there.
This whole case is one big lie after another.
I do stand corrected in something else that I said as well. The social group he was a member of that qualified him for the withholding wasn’t MS-13; it was his immediate family since he was targeted because his mother owned the pupusa shop. So it was not because of his involvement with MS-13.
The immigration judge did not consider whether, as a member of MS-13, he had been involved in the persecution of others. Probably because there would have to be evidence of specific cases of his involvement, and there was not at that time. It was probably critical that his girlfriend was scared away from pursuing the domestic abuse charges, because if it had been legally determined that he had abused her and/or the kids, he would not be eligible to receive a withholding. I wonder exactly how she was “persuaded” to back out of that.
This decision also says that Abrego Garcia failed to show up for the hearing. That doesn’t seem to get mentioned in the media reports.
Anyway, the withholding from GUATEMALA cannot render his deportation to EL SALVADOR unlawful. If this is a true copy of the original legal document, the Supreme Court, Xinis, and all the other judges are making judgments based on INCORRECT FACTS. How can this be?

I never thought to use the word Guatemala because all the news reports said he wasn’t allowed to be deported to El Salvador. I did the search using terms like that except not Guatemala. I bet google hid this document because if people knew he wasn’t forbidden from being exported to El Salvador this story would have been blown apart from the very start. There is no story here; it was all based on a lie that the records could have easily revealed.
This really does make me wonder if the lawyers doing the arguments in these cases are even competent. How have we had this many rulings based on inaccurate base information? Either the lawyers are trying to sabotage Trump, or they are trying to delay the resolution of this issue for some reason - maybe to expose how compromised the system is, or maybe to buy time to get the military cleaned out before the legal issues are at a point that the military can go in and clean up the coup we’ve been through the last 18 years or so.
I hope it’s the latter reason. But I’m really scratching my head on this new information and how we got this far without this very, very basic fact being disclosed.
