It doesn’t matter. I think the ATC order was mere seconds before the crash. Aircraft in this airspace are routinely allowed to close at much lower limits than by statute. Just insane in a congested commercial airspace with large numbers of passengers transiting daily.
If you have NVGs, you aren't 'using instruments'. The only 'instrument' is the radalt set @ 215' and you keep the red light on. Easily monitored in your scan.
